Tama County District Court
Before Judge Paul D. Miller in Tama County District Court in Toledo:
Latoya Katrina Brock, 31, Cedar Rapids, pleaded guilty in open court -by video- to one count of forgery. She received a deferred judgment for a tow year period and was placed on supervised probation to the Department of Correctional Services. She was assessed a civil penalty, surcharge and court costs totaling $1,108 and ordered to pay $1,965 in victim restitution to Everi Holdings, identified as a check cashing service.
A total of 16 additional counts of forgery were dismissed for Brock but remain active against other defendants.
Brock was accused on April 21, 2019, for being part of a fraudulent check conspiracy for cashing a known fraudulent check in the $1,954 amount at the Meskwaki Casino, rural Tama. The check had been cashed on Oct. 12,, 2016, but the charge was delayed due to an on-going investigation according to the court information filed by Meskwaki Nation Tribal Police Detective Jacob Molitor.
A trial information filed by Tama County Attorney Brent Heeren on Oct. 2, 2019, named Brock and four other defendants on the 16 forgery counts for allegedly cashing a series of fraudulent checks.
Darcy Lee Davenport, 34, Toledo, pleaded guilty to the amended charge of 2nd offense drunken driving. She was sentenced to 90 days in jail with all but seven days suspended and credited for any time already served, and fined and assessed court costs totaling $2,641. She was placed on supervised probation to the Department of Correctional Services and directed to pay the$300 supervision fee.
Davenport was originally charged on Aug. 17, 2019, on 1st Avenue by Toledo Police Officer Kyle Howe.
Johnathan Cabral Rodriguez, 36, rural Tama, received a suspended five-year prison term on a charge of 2nd degree theft and a $70 fine was also suspended. On a charge of 1st offense drunken driving he was sentenced to 180 days in jail with all but two days suspended, credited for any time already served and fined and assessed court costs totaling $2,048. was placed on supervised probation to the Department of Correctional Services and directed to pay a $300 supervision fee. He had entered written guilty pleas earlier.
Rodriguez was charged in a County Attorney’s information filed on Feb. 14 with 2nd degree theft involving a motor vehicle and 1st offense drunken driving. He was initially charged on Feb. 5 on the 200 block of Business Highway 30 West when apprehended in a 2000 model year Isuzu Rodeo for which a nationwide entry as a stolen vehicle had been made. He was charged by Toledo Police Chief Nathan Shepard.
Felipe S. Espinoza, 28, Des Moines, was sentenced to a suspended 10-year prison term on a charge of 1st degree theft and was placed on supervised probation and directed to pay a $300 supervisory fee. A $1,00 fine was suspended and he was directed to pay Enterprise-Rent-A-Car a total of $13,723 restitution for damage to a vehicle.
On a charge of 1st offense drunken driving he was sentenced to two days in jail and fined $1,250 and on a charge of possession of methamphetamine he was fined $315 and also sentenced to serve two dyas in jail with credit for any time served. He had entered written guilty pleas on March 12.
Espinoza was charged on Feb. 8 in the 1800 block of P Avenue, Traer, after driving his vehicle into a ditch by Tama County Deputy Sheriff Travis Foster.
Before District Associate Judge Scott l. Nichols:
Cade Bovenmeyer, 19, rural Gladbrook, pleaded guilty to 1st offense drunken driving. He was fined and assessed court costs totaling $1,698. The court may waive $625 of the fine amount if proof of installation of an ignition interlock device is received. He was sentenced to serve 32 days in jail with all but two days suspended and was placed on self-supervised probation to the Department of Correctional Services. He was directed to pay a $300 supervisory fee. He was also ordered to pay $29,325 restitution to Alliant Energy and $544 to Mid-Iowa Coop.
Bovenmeyer was charged on January 26 in the 200 block of Front Street, Gladbrook, after a property damage accident by Tama County Deputy Sheriff Travis Foster.
TadHaskins,34, Atlantic, Iowa, pleaded guilty to 1st offense drunken driving. He received a deferred judgment and was placed on unsupervised probation for one year. He was assessed a civil penalty and court costs totaling $1,360 of which the amount of $625 may be waived if proof of installation of an ignition interlock device is received.
Haskins was charged March 7 in the 400 block of North County Road, Toledo, by Tama county Deputy Sheriff Travis Foster.
The court continued to follow Iowa supreme court directives based upon COCID-19 precautions. A total of 26 cases management conferences were among actions continued in the period May 20 to May 27.
