Tama County District Court

Before Judge Lars G. Anderson in Tama County District Court in Toledo:

Trevor Ray Bingham, 23, Montour, was sentenced to 10 years in prison after previously pleading guilty on Sept. 26, 2019, to 3rd degree sexual abuse. He was fined, as assessed court costs and a surcharge totaling $1,700 and directed to pay $6,784 to the Crime Prevention Compensation Program. He was credited for any time previously served in connection with the case.

Bingham was charged following an alleged incident on Sept. 1, 2018, in Montour, in which he allegedly had sexual relations with a 14-year-old victim who was intoxicated. The charge was filed by Tama County Deputy Sheriff Lucas Dvorak.

Aiden Hunter Kapayou, 24, Tama, had a previous deferred judgment revoked on charges of conspire to manufacture, deliver and / or possess with intent to deliver marijuana and two counts of child endangerment. He was sentenced to a suspended five year prison term on the drug charge and placed on probation for three years to the 6th Judicial District Department of Correctional Services. For child endangerment, he was sentenced to concurrent 30-day jail sentences with credit for 30 days already served. He was ordered to successfully complete a substance abuse treatment program and to pay the probation enrollment fee. Payment of fines totaling $2,000 were suspended and court costs were waived.

Kapayou was cited in a probation violation report for failing to keep scheduled appointments with his probation officer and admitting to use of methamphetamine.

Kapayou was originally charged on Aug. 14, 2016, after a search warrant was executed at a residence in the 600 block of Hall Street after a large quantity of marijuana was allegedly located in a closet of a childs playroom in the residence. The charges were filed by Tama Police Officer Neil Frizzell.

Michael Francis Watson, 59, Marshalltown, admitted violation of terms of probation and was ordered to serve 15 days in jail with credit for any item already served. Upon completion Watson is to be discharged unsatisfactorily from probation. Due to financial circumstances of the defendant court costs and attorney fees were waived. He was cited in a probation report for failing to make scheduled appointments with the probation officer and for the probation office unable to locate him over a five-month long period.

He was orignally sentenced on March 16, 2018, after pleading guilty to possession of methamphetamine and assault causing injury. The charges were field by Meskwaki Nation Tribal Police Officer Kenneth R. Brady.

Stephen Wayne Topliff, 66, rural Traer,, entered a written guilty plea to a charge of attempted 3rd degree burglary. He received a two-year suspended sentence and was placed on probation under the custody and supervision of Cheryl Meek for two years. He must pay $350 restitution to Boyd Robert Johanningmeier, Traer.

Topliff was charged after an incident at a residence on Iowa Highway 8, rural Traer, on Sept. 11, 2019. He was charged by Tama County Deputy Sheriff Joseph Quandt.

Gregory Curtis Newsome, 28, rural Tama, admitted violation of terms of probation. He was sentenced to serve 60 days in jail on the charge of and 30 days in jail for . The sentences are to run concurrently.

Upon completion of the jail time he is to be discharged from probation unsatisfactorily. Court costs and court-appointed attorney fees were waived. Newsome was cited in a probation violation report for failure to come to Employment solutions on three occasions and failure to obtain a substance abuse evaluation.

Newsome was orignally placed on probation for 1st offense possession of a controlled substance and domestic abuse assault causing bodily injury or mental illness. He was charged after allegedly throwing a telephone at another person hitting the victim in the forehead and grabbing the victim’s face causing a bruise or bump and a farcial scratch. The incident occurred on May 15, 2019 at a residence in the 500 block of Garfield Street. Charges were filed by Tama Police Officer Tyler Ayala-Pagan. He was charged on Aug. 11, 2019, with possession of marijuana after he was taken into custody on a warrant by Tama Police Officer Jake Kessler.

Deacon Robert Fonua Jr., 32, rural Toledo, pleaded guilty to assault causing bodily injury. He received a deferred judgment, was assessed a civil penalty and court costs totaling $415 and placed on supervised probation.

Fonua was orignally charged on Dec. 4, 2019, in the 3000 block of I Avenue, rural Toledo, with domestic abuse assault- injury or mantle illness after allegedly pushing the victim who reportedly lost consciousness. The charge was filed by Tama County Deputy Sheriff Casey Schmidt.

Shanna Danyel Grok O’Clair, 32, rural Tama, entered a written guilty plea to driving while barred. he was sentenced to 180 days in jail, credited with any time already served with the balance of the sentence and a $625 fine suspended. Court costs of $100 were assessed. She was placed on unsupervised probation to the 6th Judicial District Department of Correctional Services.

O’Clair was charged on Aug. 5, 2019, on Business Highway 30 just eats of U.S. Highway 63 by State Trooper Austin Westpfahl.

Kyle James Kofron, 31, Cedar Falls, entered a written guilty plea to a charge of child endangerment. He was sentenced to 90 days in jail, with credit for any time served and the balance suspended and fined and assessed court costs totaling $1,016.

Kofron was charged on Sept. 14, 2019, at the intersection of 17th and Harding streets by Taam Police Officer Daniel Sutfin following a traffic stop.
