Deferred judgement granted in Tracy trial

Toledo, Iowa December 17th, 2020 – The Hon. Christopher Bruns, Judge of the Sixth Judicial District in the State of Iowa, granted the sentencing request of defendant Sandra Tracy for a deferred judgment and probation.

A Tama County jury found defendant Tracy, guilty of perjury, a class D felony on October 14, 2020. Defendant Tracy was indicted by Trial Information on January 6, 2020 for the offenses of perjury, and malicious prosecution stemming from her testimony at a deposition undertaken in August 2019.

On July 17, 2019, the defendant reported to the Toledo City Police, that on July 9, 2019 she was the victim of a domestic abuse assault by strangulation resulting in bodily injury and that her children were present at the time of the assault.

Law enforcement obtained a written statement from Sandra Tracy and took photographs of her injuries. Justin Tracy was arrested and incarcerated for the offenses of domestic abuse assault strangulation, and child endangerment.

On August 4, 2019, Justin Tracy, was indicted by Trial Information for the offenses of domestic abuse assault strangulation, resulting in bodily injury and 2 counts of child endangerment.

At a deposition on August 20, 2019; Sandra Tracy, while under oath, denied any recollection or memory of a domestic abuse assault or strangulation by Justin Tracy. At times during the deposition, defendant Sandra Tracy stated her husband did not assault or strangle her. A former Story County, Iowa prosecutor testified at the trial of Sandra Tracy that on two separate occasions, Justin Tracy was charged with domestic abuse assault in Story County.

The Story County prosecutions were each dismissed after testimony by Sandra Tracy, contrary to evidence gathered by law enforcement, much of which was provided by Sandra Tracy.

During sentencing, Tama County Attorney Brent Heeren directed the court’s attention to statements made by Sandra Tracy in which she denied ever being a victim of physical, emotional, verbal, or sexual abuse.

Defendant Sandra Tracy was acquitted by the Tama County jury of the crime of malicious prosecution. Perjury is punishable by confinement for no more than 5 years and a fine of at least $750, but no more than $7500.
