HunterDuane Schaper, 24, Marshalltown, admitted violation of terms of an earlier deferred judgment granted on a charge of 1st offense drunken driving. He was sentenced to seve 30 days in jail with all but two days suspended, credited for any time already served and fined and assessed court costs totaling $1,620. He was placed on unsupervised probation.
Schaper was cited in a probation violation report for being charged with 2nd offense drunken driving on Dec. 30, 2019, in Marshall Court and not providing proof of completing court-ordered Drinking Drivers School. He was originally charged in Tama County on Jan. 18, 2019, following an accident on the U.S. Highway 30 Expressway near Montour. he was cited by the Tama Co. Sheriff’s Office.
A total of 25 cases were continued in Tama County District Court during the period May 13-20 as ongoing restrictions remained in place in response to the COVID-19 pandemic.
All new district court criminal jury trials were suspended by the Iowa Supreme court on March 14.
In what the court described as a historical first, the Iowa Court of Appeals conducted a videoconferencing for oral arguments on Thursday, May 21, on a Pottawattamie County case. It is noted this was the first time in court history arguments were heard with the three-panel; of judges and attorneys appearing remotely.
The arguments were live-streamed on the internet site Iowa Court of appeals YouTube channel.
