Gladbrook school petition dismissed

A lawsuit challenging the Gladbrook-Reinbeck School Board to close the Gladbrook school has been dismissed in Tama County District court in Toledo.

District Court judge Kevin McKeever, in a ruling handed down in early January, said, in part, “The Court finds that the Board’s decision to close Gladbrook Elementary/Middle School falls within the scope of authority delegated to Iowa school boards by the legislature, and the Court finds the Board’s decision was reasonable. Thus, the Court concludes that the undisputed facts establish that the Board did not owe a duty or breach a duty owed to Plaintiffs and that there are no genuine issues of material fact in dispute that would preclude the entry of summary judgment on Plaintiffs’ breach of fiduciary duty claim.”

Judge McKeever then canceled a jury trial which had been set for Jan. 5.

A group named in court documents- Gladbrook Commercial Club, Gladbrook Investment, Inc., Gladbrook Development, Inc., Clark Gamble, Sam Peters, Lori Sanderson, Brody Davis, Tandi Davis, Grant Gearhart, Amanda Gearhart and Charles Bearden filed an amended petition in court on May 6, 2015, challenging the school board’s decision to close the school located in Gladbrook.

In a 14-page ruling Judge McKeever concluded: “the Court finds that the Board’s decision to close Gladbrook Elementary/Middle School falls within the scope of authority delegated to Iowa school boards by the legislature, and the Court finds the Board’s decision was reasonable.”
