COURT NEWS

Robert Thomas Lenz, 56, of Manson, entered a plea of not guilty on March 20, 2022, in district court to charges including three counts of first degree theft (Class C felony) and one count of first degree fraudulent practice (Class C felony). According to court documents, charges in the case stem from incidents which allegedly took place between Jan. 19, 2022, and Jan. 26, 2022. Lenz allegedly bid a total of $17,041.25 on 18 head of cattle on Jan. 26 at the Tama Livestock Auction in Tama and loaded the animals without paying for them. The cattle were then sold to another individual. At the time of the sale, Lenz had allegedly already issued a bad check to Tama Livestock Auction on Jan. 19, in the amount of $30,313.60 which, according to the criminal complaint, was for 30 head of cattle. Lenz has waived his right to a speedy trial. A jury trial has been scheduled for June 27, 2022, at 9:00 a.m. Lenz is represented by attorney Allan M. Richards of Tama.

Kristen Lynn Arp, 56, of Traer, appeared in district court on March 24, 2022, for sentencing after negotiating a plea agreement on February 18, 2022. On Feb. 18, Arp entered a written plea of guilty to the lesser charge, Count 5, of assault while using or displaying a dangerous weapon (aggravated misdemeanor). Arp was charged previously on six counts including two counts of first degree robbery (Class B felony), one count of first degree burglary (Class B felony), going armed with intent (Class D felony), one count of assault while using or displaying a dangerous weapon (aggravated misdemeanor), and one count of willful injury causing bodily injury (Class D felony). Charges stem from an incident which took place on October 28, 2021, at a rural Elberon residence. At the time of the incident, Arp was in violation of a valid no-contact order in place. According to the criminal complaint, Arp allegedly committed burglary in the first degree upon the property while persons were present, and intentionally or recklessly inflict bodily injury on the victim. On March 24, Arp was sentenced on Count 5 to serve 30 days in jail and pay a fine of $855 plus surcharges and court costs. Payment of the fine was suspended and Arp was given credit for 30 days previously served. The remaining five counts in this case will be dismissed with costs assessed to Arp after the felony case against William Mitchell Jones – also charged in this incident – is resolved. A jury trial for Jones is scheduled for April 18, 2022, at 9:00 a.m. Arp has been represented by attorney Eric Tindal of Iowa City in this matter.
