A rural Garwin man was found innocent of two counts of taking possession of deer out-of-season in a ruling issued by Tama County Magistrate Richard Vander Mey.
Chad R. Anderson, 40, faced the charges filed by State Conservation Officer Brett Reece in a trial held May 13. He was accused of being in possession of two fawns in charges filed on July 14, 2013.
In the ruling, Vander Mey said he recognized both the officer and defendant's positions. He said he found the Iowa Code violation "related to hunting and killing" and "the defendant was preserving the life of two fawns. Anderson maintained he had kept the fawns to rehabilitate them and planned to turn them over to a licensed or certified wildlife rehabilitation person.
A ruling in a second trial over a deer violation went the other way for a Clutier man.
Anthony J. Harris, 26, was found guilty of failure to report a deer harvest and improperly disposing of a deer carcass. The charges were filed on Jan. 27 by Reece.
Harris was fined and assessed court costs totaling $394 by Vander Mey.
Tracy Lee Young, 48, Marengo, was found guilty following trial on a charge of driver under the influence of alcohol. Commercial drivers who test under the legal limit for alcohol in their system may still be charged if there is a level of alcohol detected according to a court official.
The charge was filed by a DOT Motor Vehicle enforcement officer. Young was assessed a fine and court costs totaling $128.
