Sentenced in Tama pedestrian fatality accident

Tim Andrew Nunnikhoven, 31, Montour, has been fined and received a suspended, 30-day jail sentence as the result of the car-pedestrian accident which resulted in the death of Ian Michael McFate, 13, Toledo, in October, 2012.

Nunnikhoven was fined a total of $196 and assessed $82 in court costs for speeding 6-10 miles over the speed limit in an order filed June 4 by Tama County Magistrate Richard Vander Mey.

Nunnikhoven was also sentenced to a suspended 30-day jail sentence.

On May 9, he entered guilty plea to the charge in a plea agreement according to court records.

Magistrate Vander Mey said in the order he agreed to follow the plea agreement on the condition McFate's family approved and accepted it.

McFate was practicing with the South Tama Middle school cross country team when he attempted to cross West 13th Street in Tama at the STC Recreation Trail crossing and was struck by Nunnikhoven's vehicle.

As a result of the tragedy, the City of Tama and Tama county had taken steps to add to safety at the Rec Trial corssing on West 13th Street including adding a stop sign and speed limit enforcement measures.
