Rural Tama man sentenced to Marshalltown Halfway House
Gerald Reese Morgan, 21, rural Tama, won't go to prison, but will spend up to one year at the Marshalltown Halfway House. That was the decision of Judge Mitchell E. Turner in Tama County District Court in Toledo on June 8.
He was also placed on probation for three years to the 6th Judicial District Department of Correctional Services.
Morgan faced a series of charges in three separate incidents to which he had entered guilty pleas.
On charges of 2nd degree criminal mischief he was sentenced to a suspended five year prison term, fined $750 and ordered to pay restitution totaling $1,417 to the Tama-Toledo Country Club.
Morgan had been charged on July 28, 2011, for allegedly driving a sports utility-type vehicle around the golf course on Tama's west side by Tama Police Sergeant Jeff Filloon.
On Aug. 7, 2011, Morgan was charged with drunken driving, eluding while intoxicated and 1st degree harassment by Toledo Police Officer Chris Knouse.
Morgan was charged at B Street and U.S. Highway 30 after being stopped. Court records indicate he allegedly threatened to kill the officer and the officer's family after being apprehended.
He was fined $1,250 for drunken driving and sentenced to 60 days in jail with credit for 60 days already served. One-half the fine may be suspended if proof of an interlock ignition device is provided.
For eluding while intoxicated he received a suspended five year prison term and a suspended $750 fine.
For harassment he received a suspended two-year prison term and a fine of $625 was suspended.
On March 7, 2012, Morgan was interference with official acts, dangerous weapon and possession of a controlled substance, marijuana. He allegedly fled on foot during what was described as a warrant check in the 1800 block of Tama County Road E49.
Court documents state Morgan was armed with a Glock .357 pistol carried in a pancake holster when taken into custody by Meskwaki Nation Tribal Police Offcier Lee Posusta.
Morgan was sentenced to a suspended, five-year prison term for interference and was fined $750. On the marijuana charge he was sentenced to two days in jail with credit for two days already served, was fined $315 and his driver's license was revoked for 180 days after other revocations have terminated.
