TOLEDO CHRONICLE - A 20-year-old Massachusetts man received a 10-year prison sentence and a special sentence was imposed in the case in Tama County District Court on Sept. 10. Timothy James Underwood, Somerset, Mass., was also sentenced for the ‘rest of his life’ under the special sentence by Judge Robert E. Sosalla. After serving prison time, he will be under supervision as if on parole during his entire lifetime. Underwood must register as a sex offender for life and was fined $1,000. He pled guilty on July 30 to 3rd degree sexual abuse. In sentencing Underwood, four other counts of 3rd degree sexual abuse were dismissed. He was accused of the five sexual abuse charges in incidents involving a person under the age of 13. The alleged abuse took place in Garwin during the early part of April. The charges were filed on April 15 by Tama County Deputy Sheriff Joe Quandt. Drew Alan Mathes, 25, Toledo, was found in contempt of court for failure to complete a court-ordered Batterer’s Education program. He received a 30-day suspended jail sentence and must complete the program by March 7, 2010. Brian Eugene Harmon, 35, Mingo, pled guilty to a charge of assault causing bodily injury. He was sentenced to 10 days in jail with credit for 10 days served and fined $315. Harmon was charged on Dec. 14, 2008, with 3rd degree domestic assault with bodily injury by Tama Police Sgt. Jeff Filloon. Jessica Marie Youngbear, 19, Traer, pled guilty of possession of marijuana with intent to deliver. She received a deferred judgement, was placed on probation for two years and assessed a $750 civil penalty. Youngbear was originally charged with two counts of delivery of marijuana to a minor on April 15 by Meskwaki Nation Tribal Police officer Julian Rivera. |
